The Federal Court of Switzerland thinks that a man who unknowingly infects a woman with HIV could be held responsible for his actions. So can anyone be held liable for infecting someone else with an std/hiv unknowingly? Maybe yes. And that’s what this decision is all about. Whatever happens, it’s probably best to know your HIV status anyways. So get tested.
This is the outcome of a recent decision made in Lausanne the home to highest Swiss Court.
I don’t know about other similar decisions in other countries, but maybe you can let us know in the comments if you know of any other examples. In any case you may want to read some closely related info about criminal transmission of HIV. This is the case when you know you’re HIV positive and still have unprotected sex with someone else.
